1. Acceptance
By creating an account or using Daily Portion Buddy ("the Service"), you agree to these Terms. If you don't agree, please don't use the Service.
2. What the Service is (and isn't)
Daily Portion Buddy is a self-tracking tool for food servings and mood. It is not medical, nutritional, dietary, or mental health advice. Don't use it to diagnose, treat, or make decisions about any medical condition. Talk to a qualified professional for that.
3. Your account
- You're responsible for keeping your login credentials secure.
- You must be old enough to enter a binding contract in your jurisdiction.
- You're responsible for activity that happens under your account, including invites you send and data you enter about yourself or your family members.
4. Acceptable use
You agree not to:
- Use the Service to harass, harm, or invade the privacy of another person.
- Invite people to a Family or Social Circle without their permission, or send unsolicited invites in bulk.
- Attempt to break, reverse-engineer, or circumvent the Service's security or access controls.
- Use the Service to violate any applicable law.
We may suspend or terminate accounts that violate these Terms.
5. Your content
You keep all rights to the data you enter (categories, servings, mood entries, notes). You grant us a limited license to store and process that data solely to operate the Service for you and the people you choose to share with.
6. Availability and changes
We may update, add, or remove features, and we may occasionally take the Service offline for maintenance. We may also update these Terms; if the changes are material, we'll update the "Last updated" date above.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that data will never be lost.
8. Limitation of liability
To the maximum extent permitted by law, Bell Cyberworks LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD $50.
9. Termination
You may stop using the Service and request account deletion at any time by emailing support@dailyportionbuddy.com. We may terminate or suspend your access if you violate these Terms.
10. Governing law
These Terms are governed by the laws of the United States and, where applicable, the state where Bell Cyberworks LLC is organized, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located there.
